ตามที่ปรากฏเหตุการณ์ประชาชนชาวมุสลิมนับพันคนรวมตัวประท้วง “มาดามราม 53” ติ๊กต๊อกเกอร์ผู้มีความหลากหลายทางเพศ ในพื้นที่ซอยรามคำแหง 53 จากการแต่งหน้าและแต่งกายเหมือนสตรีมุสลิม แสดงพฤติกรรมที่มีลักษณะดูหมิ่นศาสนา ล้อเลียนอัลกุรอ่านผ่านสื่อสังคมออนไลน์ จนนำสู่การไลฟ์สดปลุกเร้าอารมณ์และกดดันให้ติ๊กต๊อกเกอร์รายดังกล่าวโกนศีรษะเพื่อแสดงความขอโทษ 

               คณะกรรมการสิทธิมนุษยชนแห่งชาติ (กสม.) ยืนยันว่า บุคคลทุกคนย่อมมีเสรีภาพในการนับถือศาสนาและการแสดงความคิดเห็น แต่การแสดงออกดังกล่าวโดยเฉพาะอย่างยิ่งในพื้นที่สาธารณะต้องเคารพในความเชื่อ และความศรัทธาของผู้คนในทุกศาสนา การดูหมิ่นเหยียดหยามศาสนาใดก็ตามจึงเป็นการละเมิดสิทธิของผู้อื่นที่ได้รับการรับรองทั้งตามหลักกฎหมายและหลักสิทธิมนุษยชน ขณะเดียวกัน ก็ไม่มีบุคคลใดสมควรถูกลงโทษนอกเหนือขอบเขตของกฎหมายหรือถูกกดดันบีบบังคับให้กระทำการใด ๆ อันเป็นการละเมิดสิทธิในชีวิตและเนื้อตัวร่างกาย รวมทั้งละเมิดในศักดิ์ศรีความเป็นมนุษย์

               โดยที่สังคมไทยเป็นสังคมพหุวัฒนธรรมที่มีความแตกต่างหลากหลายทางความคิด ความเชื่อ ศาสนา และอัตลักษณ์ทางเพศ กสม. ขอเน้นย้ำให้บุคคลสาธารณะและผู้คนในสังคมออนไลน์ใช้ความระมัดระวังในการสื่อสารประเด็นอ่อนไหวที่ง่ายต่อการขยายและนำไปสู่การสร้างความเกลียดชัง แตกแยก และการใช้ความรุนแรงต่อกัน อันไม่เป็นผลดีต่อการอยู่ร่วมกันด้วยความเคารพในสิทธิของผู้อื่นและหลักสันติภาพอันเป็นแก่นสำคัญของทุกศาสนา

Statement of the National Human Rights Commission of Thailand

on Respect for Human Dignity and Responsible Communication on Sensitive Issues regarding the Incident at Ramkhamhaeng Soi 53

          The National Human Rights Commission of Thailand (NHRCT) has taken note of reports concerning the gathering of thousands of Muslim community members protesting against "Madam Ram 53," an LGBTQ+ TikTok creator, in the Ramkhamhaeng Soi 53 area. The protest reportedly arose from online content in which the TikToker wore attire and makeup resembling those of Muslim women and displayed behavior perceived as insulting to religious beliefs, including mockery of the Qur’an. The situation subsequently escalated through emotionally charged livestreams and public pressure compelling the individual to shave the head as an act of apology.

          The NHRCT reaffirms that every person is entitled to freedom of religion and freedom of expression. However, such expression— particularly in public spaces— must be exercised with due respect for the beliefs and faith of people of all religions. The denigration or mockery of any religion therefore constitutes a violation of the rights and dignity of others, as protected under both the legal and international human rights principles. At the same time, no person should be subjected to punishment beyond the bounds of the law, nor be coerced or pressured into performing any act that infringes upon their right to life and bodily integrity, or human dignity.

          Given that Thailand is a multicultural society characterized by diversity in thought, belief, religion, and gender identity, the NHRCT calls upon public figures and all members of online community to exercise caution and responsibility when communicating on sensitive issues that may easily escalate into hatred, social division, and violence against each other. Such outcome is detrimental to peaceful coexistence, mutual respect for the rights of others, and the principles of peace, which are fundamental to all religions.
