ตามที่ได้มีการเลือกตั้งสมาชิกสภาผู้แทนราษฎร และการออกเสียงประชามติ เมื่อวันที่ 8 กุมภาพันธ์ 2569 ที่ผ่านมา ซึ่งเป็นกระบวนการสำคัญตามระบอบประชาธิปไตย เพื่อให้ประชาชนได้ใช้สิทธิแสดงเจตจำนงอย่างเสรีและเสมอภาค ตามที่รัฐธรรมนูญแห่งราชอาณาจักรไทย และกติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง (ICCPR) ให้การรับรองไว้

            คณะกรรมการสิทธิมนุษยชนแห่งชาติ (กสม.) ได้ติดตามสถานการณ์การเลือกตั้งครั้งนี้ ด้วยความห่วงกังวลยิ่งต่อกรณีความผิดพลาดและความแตกต่างของผลคะแนนที่นำไปสู่การตั้งคำถามถึงการเลือกตั้งว่าเป็นไปตามข้อกำหนดตามกฎหมาย และโดยบริสุทธิ์ยุติธรรมหรือไม่ รวมถึงบัตรเสียที่มีจำนวนมาก นอกจากนี้ยังมีประชาชนกลุ่มต่าง ๆ นิสิตนักศึกษา และนักวิชาการ เรียกร้องให้มีการตรวจสอบและนับคะแนนใหม่ในหลายพื้นที่ทั่วประเทศ ซึ่งสะท้อนถึงวิกฤตความเชื่อมั่นต่อกระบวนการเลือกตั้งที่มีผลโดยตรงต่อสิทธิพลเมืองและสิทธิทางการเมืองของประชาชน รวมทั้งอาจส่งผลต่อความเชื่อมั่นในสายตานานาชาติ อันจะส่งผลกระทบต่อเศรษฐกิจและการลงทุนจากต่างประเทศได้ด้วย

            กสม. ขอเน้นย้ำว่า การเลือกตั้งโดยเสรี สุจริต เป็นธรรม ปราศจากการข่มขู่ คุกคาม หรือการใช้อำนาจโดยมิชอบ เป็นองค์ประกอบสำคัญของการเคารพสิทธิมนุษยชน จึงขอเรียกร้องให้หน่วยงานที่มีอำนาจและหน้าที่ที่เกี่ยวข้องเร่งดำเนินการแก้ไขปัญหาและตรวจสอบข้อเท็จจริงเกี่ยวกับการเลือกตั้งอย่างโปร่งใส รวดเร็ว โดยคำนึงถึงหลักนิติธรรม และเปิดเผยข้อมูลให้ประชาชนสามารถเข้าถึงได้อย่างสะดวก รวมทั้งชี้แจงต่อสาธารณะอย่างชัดเจน เพื่อสร้างความเชื่อมั่นแก่ประชาชน และเพื่อให้การเลือกตั้งนำไปสู่การเปลี่ยนผ่านทางการเมืองที่อยู่บนพื้นฐานของการเคารพหลักสิทธิมนุษยชนและหลักประชาธิปไตยอย่างแท้จริง

Statement of the National Human Rights Commission of Thailand (NHRCT)

On Expediting Investigation and Disclosure of Facts Concerning
the 2026 General Election and Referendum

          The general election and the referendum held on 8 February 2026 are crucial processes within a democratic system, through which citizens were able to exercise their rights to express their will freely and equally, as guaranteed in the Constitution of the Kingdom of Thailand and the International Covenant on Civil and Political Rights (ICCPR).

          The NHRCT has been monitoring the election with grave concern over reports of discrepancies in vote tabulation and the number of invalid ballots, which have led to public questions as to whether the election was conducted in compliance with the law and in a free and fair manner. In addition, various groups of citizens, students, and academics have called for verification of results and recounts in many areas across the country. These concerns reflect a crisis of confidence in the electoral process, which directly impacts the civil and political rights of the people. This situation may also affect international confidence, potentially undermining the country’s economy and foreign investment climate.

          The NHRCT reiterates that elections conducted in a free, fair, and transparent manner, without intimidation, threats, or abuse of power, are essential components of respect for human rights. The Commission calls upon the competent authorities to urgently address the issues and conduct a swift and transparent investigation into the electoral facts in accordance with the rule of law.  Relevant information should be made easily accessible to the public, accompanied by clear explanations to restore public confidence. Such measures are essential to ensure that the electoral process leads to a political transition grounded in genuine respect for human rights and democratic principles.
