ตามที่มีรายงานว่าทางการไทยได้ส่งตัวนาย อี ควิน เบดั๊บ (Y Quynh BDAP) นักเคลื่อนไหวเพื่อเสรีภาพในการนับถือศาสนาชาวเวียดนาม กลุ่มชาติพันธุ์มองตานญาด (Montagnards) เป็นผู้ร้ายข้ามแดนกลับไปยังประเทศเวียดนาม เมื่อวันที่ 28 พฤศจิกายน 2568 ตามคำร้องขอของทางการเวียดนาม นั้น

               คณะกรรมการสิทธิมนุษยชนแห่งชาติ (กสม.) มีความห่วงใยต่อการส่งนายอี ควิน เบดั๊บ กลับประเทศเวียดนาม เนื่องจากบุคคลดังกล่าวเป็นผู้ที่อยู่ระหว่างการขอลี้ภัยไปประเทศที่สาม และอยู่ในความคุ้มครองของสำนักงานข้าหลวงใหญ่ผู้ลี้ภัยแห่งสหประชาชาติ (UNHCR)  กสม. ยังได้รับข้อมูลว่าการส่งตัวนายอี ควิน เบดั๊บ เป็นไปอย่างเร่งรัดและครอบครัวยังไม่ทราบข้อมูลใด ๆ เกี่ยวกับชะตากรรมของนายอี ควิน เบดั๊บ หลังจากที่มีรายงานการส่งกลับ  ทั้งนี้ กสม. เคยแสดงความห่วงใยต่อการที่ทางการไทยจับกุมนายอี ควิน เบดั๊บ เมื่อเดือนมิถุนายน 2567 และเห็นว่า การส่งตัวบุคคลดังกล่าวกลับประเทศต้นทางอาจไม่สอดคล้องกับหลักการห้ามผลักดันกลับสู่อันตราย หรือ non-refoulement ซึ่งเป็นกฎหมายจารีตประเพณีระหว่างประเทศ และอาจส่งผลกระทบต่อความเชื่อมั่นของประเทศไทยในฐานะสมาชิกของคณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติ  

               กสม. หวังว่ารัฐบาลไทยจะติดตามสถานการณ์การส่งกลับผู้ลี้ภัยรายนี้อย่างใกล้ชิด เพื่อให้มั่นใจว่าบุคคลดังกล่าวจะได้รับการความคุ้มครองความปลอดภัยในชีวิตและร่างกายตามหลักสากล

Statement of the National Human Rights Commission of Thailand (NHRCT)

Concerns Regarding the Extradition of a Montagnard Refugee to Viet Nam

           The National Human Rights Commission of Thailand (NHRCT) expresses its deep concern regarding reports that Thai authorities extradited Mr. Y Quynh BDAP, a Vietnamese religious freedom activist from the Montagnard ethnic group, to Viet Nam on 28 November 2025 at the request of the Vietnamese government.

          Mr. Y Quynh BDAP was in the process of seeking asylum in a third country and was under the protection of the United Nations High Commissioner for Refugees (UNHCR). The NHRCT has also received information indicating that the extradition was carried out swiftly, and that his family has not been informed of his situation or whereabouts following reports of his return.

           The NHRCT had previously raised concerns when Mr. Y Quynh BDAP was arrested by the Thai authorities in June 2024, noting that his return to the country of origin may be inconsistent with the principle of non-refoulement, which constitutes a norm of customary international law. Such action could also affect confidence in Thailand's commitment as a member of the United Nations Human Rights Council.

          The NHRCT urges the Thai government to closely monitor the situation following the extradition of Mr. Y Quynh BDAP to ensure that his life and physical security are safeguarded in accordance with international standards.
