ตามที่ปรากฏข้อถกเถียงและความขัดแย้งทางความคิดในสังคม อันมีที่มาจากการแสดงความคิดเห็นสาธารณะต่อการจัดการปัญหาสถานการณ์ชายแดนไทย-กัมพูชา กระทั่งมีการสื่อสารโดยสร้างความเกลียดชังอย่างแพร่หลายในสื่อสังคมออนไลน์ และนำไปสู่การข่มขู่คุกคามบุคคลผู้มีความคิดเห็นต่างนั้น

            คณะกรรมการสิทธิมนุษยชนแห่งชาติ (กสม.) มีความกังวลต่อสถานการณ์ดังกล่าวเป็นอย่างยิ่งด้วยตระหนักว่า บุคคลย่อมมีเสรีภาพทางความคิดและมีสิทธิที่จะแสดงความคิดเห็นโดยปราศจากการแทรกแซงโดยการแสดงความเห็นนั้นต้องเคารพในสิทธิหรือชื่อเสียงของบุคคลอื่น อันสอดคล้องตามข้อ 18 และ19 ของกติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง (ICCPR) ที่ประเทศไทยเป็นภาคี ด้วยเหตุนี้จึงไม่มีบุคคลใดสมควรถูกข่มขู่คุกคาม ทำให้หวาดกลัว หรือถูกจำกัดเสรีภาพในการสื่อสารเพราะการแสดงความคิดเห็นที่แตกต่าง

            กสม. เห็นว่า ในสังคมประชาธิปไตยและสังคมที่มีความหลากหลายทางเชื้อชาติ ศาสนา หรือความคิดความเชื่ออื่นใด การเคารพในสิทธิมนุษยชนของทั้งตนเองและผู้อื่นเป็นเรื่องที่สังคมต้องให้ความสำคัญและร่วมกันเรียนรู้ โดยเฉพาะในห้วงเวลาแห่งความขัดแย้ง เช่น สถานการณ์บริเวณชายแดนขณะนี้ ซึ่งมีความเสี่ยงที่ความเห็นต่างจะปลุกเร้าให้เกิดการสร้างความเกลียดชังและความรุนแรงในรูปแบบต่าง ๆ ตามมา อันไม่เป็นผลดีต่อการสร้างสันติภาพระหว่างรัฐและความสงบสุขของประชาชนในพื้นที่

            ด้วยเหตุนี้ กสม. จึงขอเน้นย้ำให้ทุกฝ่ายเคารพในความเห็นต่างและศักดิ์ศรีความเป็นมนุษย์ของคนทุกคนที่แม้จะแตกต่างกันด้วยเชื้อชาติ ศาสนา ภาษา หรือสถานะทางสังคมอื่นใด แต่ต่างก็มีคุณค่าในตนเอง ทั้งนี้ ขอให้สังคมร่วมกันสร้างพื้นที่ปลอดภัยในการแสดงความคิดเห็นและการวิพากษ์วิจารณ์อย่างสร้างสรรค์ ไม่ยอมรับการสร้างความเกลียดและการละเมิดศักดิ์ศรีความเป็นมนุษย์ในทุกรูปแบบ

Statement of the National Human Rights Commission of Thailand (NHRCT)

Calling on all parties to respect differences of opinion and reject hate speech

                The NHRCT has observed that recent public debates and ideological conflicts arising from discussions on the situation along the Thai–Cambodian border have resulted in the widespread dissemination of hate speech on social media platforms, as well as threats and intimidation directed at individuals expressing differing opinions.

                The NHRCT expresses its deep concern over these developments and reaffirms that everyone has the right to freedom of thought and the right to hold opinions without interference, as well as the right to freedom of expression, in accordance with Articles 18 and 19 of the International Covenant on Civil and Political Rights (ICCPR), to which Thailand is a State Party. These rights, however, must be exercised with due respect for the rights and reputations of others. No person should be subjected to threats, intimidation, or restrictions on communication merely for holding or expressing a different view.

                The NHRCT emphasizes that in a democratic and pluralistic society - where people of diverse ethnicities, religions, and beliefs coexist - respect for one’s own rights and the rights of others must be upheld as a shared societal value. This is particularly vital in times of heightened tension, such as the current border situation, where differing opinions must not be exploited to incite hatred or violence, which would only hinder efforts to foster peace between nations and harmony among communities in affected areas.

                The NHRCT therefore urges all parties not only to respect diversity and differences of opinion but also to uphold the inherent dignity of every person, regardless of race, religion, language, or social status. The NHRCT calls upon all sectors of society to promote a safe and constructive environment for public expression and dialogue, and to unequivocally reject all forms of hate speech as part of our collective effort to address current challenges in accordance with universal human rights principles.
