ในอดีตเด็กที่ติดตามครอบครัวคนต่างด้าวหรือผู้ลี้ภัยที่เข้ามาแสวงหาที่พักพิงในไทย ต้องถูกขังรวมกับผู้ใหญ่ในสถานที่กักตัวคนต่างด้าวในระหว่างรอการส่งกลับประเทศต้นทาง หรือ เดินทางต่อไปยังประเทศที่สาม เป็นผลให้เด็กต้องอยู่ในสถานที่แออัด ขาดโอกาสในการได้รับการศึกษา การพัฒนาตามวัย ทั้งยังมีความเสี่ยงต่อการถูกละเมิดสิทธิในรูปแบบต่าง ๆ คณะกรรมการสิทธิมนุษยชนแห่งชาติตระหนักถึงปัญหาดังกล่าว จึงได้มีข้อเสนอแนะให้รัฐบาลพิจารณาทางเลือกแทนการกักตัวเด็กที่ติดตามครอบครัวคนต่างด้าว โดยให้เด็กได้มีโอกาสอยู่ร่วมกับผู้ปกครองในสถานที่ที่เหมาะสม ซึ่งเป็นที่น่ายินดีว่ารัฐบาลพลเอกประยุทธ์ จันทร์โอชา เห็นความสำคัญเรื่องดังกล่าว จึงได้มีบัญชาให้หน่วยงานที่เกี่ยวข้อง 7 หน่วยงาน ได้แก่ สำนักงานตำรวจแห่งชาติ (โดย สำนักงานตรวจคนเข้าเมือง) กระทรวงพัฒนาสังคมและความมั่นคงของมนุษย์ กระทรวงการต่างประเทศ กระทรวงมหาดไทย กระทรวงสาธารณสุข กระทรวงศึกษาธิการ และกระทรวงแรงงาน จัดทำ “บันทึกความเข้าใจ เรื่อง การกำหนดมาตรการและแนวทางแทนการกักตัวเด็กไว้ในสถานกักตัวคนต่างด้าวเพื่อรอการส่งกลับ” ร่วมกัน เมื่อวันที่ 21มกราคม 2562 เป็นผลให้ปัจจุบันประเทศไทยไม่มีเด็กที่ต้องถูกกักขังรวมกับผู้ใหญ่ อันถือเป็นความก้าวหน้าครั้งสำคัญในการคุ้มครองสิทธิขั้นพื้นฐานให้แก่เด็กต่างด้าวในประเทศ In the past, migrant children who accompanied their families were detained with their parents in overcrowded immigration detention centers while waiting to be sent back to their origin country or transferred to the third country. This resulted in their dire situations, flocking together in crowded places, losing the opportunity to study and prone to various forms of violation. The National Human Rights Commission of Thailand is very concerned of the situations, thus recommending to the government to consider alternative means in which children can stay with their families in a more suitable environment. Upon Prime Minister General Prayut Chan-o-cha’s instruction, it is very welcome that, on 21st January 2019, relevant governmental agencies including the Royal Thai Police (the Immigration Bureau), the Ministry of Social Development and Human Security, the Ministry of Foreign Affairs, the Ministry of Interior, the Ministry of Public Health, the Ministry of Education, and the Ministry of Labor signed the Memorandum of Understanding on the Determination of Measures and Approaches Alternative to Detention of Children in Immigration Detention Centers”. Thailand now has no migrant children living with their families in detention centers.
